The AUGMNT websites have been created for informational purposes only on a best effort basis and is not intended to be used as a complete source of information on any particular subject and should not be relied upon in making any decisions. IF SOME PROVINCES or STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. AUGMNT’s site we refer or link to other parties’s website and vice versa. Be formally notified that AUGMNT has not reviewed any or all of the sites its link to or that link to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by AUGMNT of any or said site. Use of any such linked website is at the user’s own risk.

7. Modifications

AUGMNT reserves the right, at its own discretion to revise, modify to replace any part of the present terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

This Agreement shall be treated as though executed, set in force, and performed in the Province of Quebec, district of Montreal. Accordingly, it shall be governed and construed in accordance with the laws of Quebec in terms of those applicable to agreements, without regard to conflict of law principles.

9. Contra Preferentum

The language in these Terms of Use shall be interpreted as to its fair meaning and not strictly for or against any party. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party (i.e. – “contra preferentum”) shall not apply in interpreting these Terms of Use, as the Agreement shall be construed as having been co-authored by the parties.

10. Severability

Should any part of these Terms of Use be held invalid or unenforceable, that portion shall be construed as much as possible consistent with applicable law and severability shall apply to the remaining portions, so that they remain in full force and effect.

11. Survivability

To the extent that anything in or associated with our website is in conflict or inconsistent with these Terms of Use, these Terms of Use shall take precedence. If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. 

12. Waiver

A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. Our failure to enforce any provision of these Terms of Service and Conditions of Use shall not be deemed a waiver of the provision nor of the right to enforce the provision. Our rights under these Terms of Service and Conditions of Use shall survive any termination of this agreement. Any rights not expressly granted herein are reserved to AUGMNT.

13. Assignability

You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; AUGMNT may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.

14. Disputes

Any cause of action by you with respect to our AUGMNT website must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All actions shall be subject to the limitations set forth in these TOS. 

Any legal claim arising out of or relating to these TOS or our website, excluding intellectual property right infringement and other claims by us, shall be settled confidentially through mandatory binding arbitration per the the laws of Quebec. 

Unless the parties decide otherwise in an arbitration agreement, the arbitration shall be conducted under the aegis of an arbitrator alone and shall be conducted in accordance with the rules of law and the provisions of the Code of Civil Procedure of Québec, in force at the time of this dispute. 

The arbitration shall take place in Montreal, Canada, in the French language or in English if claiming party does not speak French The arbitration award shall be final, binding and without appeal and binding on the parties. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys’ fees. If you prevail over AUGMNT, no fees paid to you, including attorney’s fees, may exceed what you have paid to AUGMNT in the prior 12 months.

Privacy Policy

Introduction

This is the privacy statement for the websites. In this statement we explain our policy with respect to personal data collected through this website. Your trust is important and that in the preparation of the present website, please assume that:

  • We are not paid to produce any of content posted on the present website, Twitter or Instagram or other social network accounts,
  • When there are affiliate links, they will be fully disclosed punctually (like Amazon for books),
  • There are presently no sponsors for our content and when there will be such, they will not be allowed to use any tracking codes, no information will be shared with them and they shall not be compensated by us or derive any revenues from this website,
  • We have full editorial control,
  • We do not post on Facebook at this point and if we do in the future, we will not have any of their tracking pixel.

We use a third-party vendor (Mailchimp, Convertkit and the likes.) as our newsletter opt-in and delivery service a as well as Google Analytics. This visitor information may be used to improve the Site.
